Solitary Confinement of Homosexual Found to be Discriminatory

On 9 October 2012, the European Court of Human Rights (ECtHR) published its first ruling of a breach of Article 3 in relation to discriminatory treatment on the ground of sexual orientation. In its judgment in the case X v Turkey it ruled that detaining a homosexual man in solitary confinement with no social interaction as a result of his request to be separated from people harassing him because of his sexual orientation constituted discriminatory inhuman and degrading treatment. 

Turkey's Passive Response to Domestic Violence Against Women Violates the Right to Non-Discrimination

On 9 June 2009, the European Court of Human Rights handed down the decision in the case of Opuz v. Turkey (Application no. 33401/02). In its judgment, the Court found that Turkey violated Article 2, Article 3 and Article 14 in conjunction with Articles 2 and 3 of the European Convention on Human Rights. 

Turkey: Constitutional Amendments Lifting Headscarf Ban in Higher Education

The Equal Rights Trust welcomes the adoption by Turkey’s parliament on 9th February 2008 of two constitutional amendments that will ease restrictions on the freedom to wear the Islamic headscarf in public higher education institutions. It has been widely reported that the ban has led to a reduction in the number of women attending higher education and placed women who wear the headscarf as a matter of religious conviction at a disadvantage with regards to the exercise of their right to manifest their religious beliefs and access education.
