On 9 March 2018, the Equal Rights Trust submitted a third party intervention in the case of Romanov v Russia (App Nos: 58358/14, 7146/15, and 25887/15), concerning a state’s response to attacks, perpetrated by private individuals, which were allegedly motivated by bias against sexual and gender minorities. The Trust’s submission focuses specifically on the Article 3 allegations in the case, and argues that it is critical that Article 14 of the Convention be examined where there is a prima facie case that violence is motivated by bias against sexual or gender minorities, since discrimination is a central element of the violation, and the state has specific obligations under Article 14 which arise from the alleged existence of discrimination
